OVERVIEW
Welcome to AeroBand Europe B.V.! The terms "we", "us" and "our" refer to AeroBand Europe B.V.. AeroBand Europe B.V. operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). AeroBand Europe B.V. runs on Shopify, which enables us to provide the Services to you.
The terms below, together with all policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when using the Services.
Please read these Terms of Service carefully, as they contain important information about your legal rights and cover topics such as the right of withdrawal, warranty and liability.
These Terms do not affect the mandatory statutory rights you have as a consumer under Dutch law and EU consumer law. Where a provision in these Terms conflicts with those mandatory consumer rights, your statutory rights prevail.
By accessing, interacting with or using our Services, you agree to these Terms of Service and our Privacy Policy at aeroband.eu/policies/privacy-policy. If you do not agree to these Terms of Service or our Privacy Policy, you must not use or access our Services.

ARTICLE 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least 18 years old (or have reached the age of majority in your country of residence), and that you have given us permission to allow any minors who depend on you to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or viewing our online stores or purchasing products or services we offer, you may be asked to provide certain information, such as your email address and billing, payment and shipping details. You represent and warrant that all information you provide in our stores is accurate, current and complete, and that you have all rights necessary to provide this information.
You are responsible for securing your login credentials and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

ARTICLE 2 - OUR PRODUCTS
We have made every effort to display our products and services in our online stores accurately. Please note, however, that the colours or appearance of products may differ from how they appear on your screen, depending on the device you use to access the store and on your device's settings and configuration.
Minor variations in colour or display do not constitute a defect. This does not affect the requirement that delivered products must conform to the agreement, as described in Article 8 (Conformity and warranty).
All product descriptions may be changed at any time without prior notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products offered on a case-by-case basis for a particular person, region or jurisdiction.

ARTICLE 3 - ORDERS
When you place an order, you make an offer to purchase. AeroBand Europe B.V. reserves the right to reasonably accept or refuse your order. Your order is only accepted once AeroBand Europe B.V. confirms acceptance, usually via an order confirmation by email. We must have received and processed your payment before your order is shipped.
Please review your order carefully before placing it. If you wish to cancel an order, contact us as soon as possible at info@aeroband.eu; as long as the order has not yet been shipped, we will try to accommodate cancellation. This does not affect your statutory right of withdrawal (Article 6). If we do not accept, change or cancel an order, we will try to inform you using the email address, billing address and/or phone number provided with the order, and we will refund any amounts already received.

ARTICLE 4 - PRICES AND PAYMENT
The prices shown in our store for consumers are in euros and include VAT, unless expressly stated otherwise. Any shipping costs are stated separately and shown before completing the order. For deliveries or customers outside the European Union, additional customs or import duties may apply, which are at the customer's expense.
Prices, discounts and offers may change without prior notice. The price charged is the price applicable at the time the order is placed and is stated in your order confirmation email.
We accept, among others, the following payment methods: iDEAL, Wero, Klarna, credit card (Visa, Mastercard, American Express), PayPal, Apple Pay and Google Pay. Payment must be made according to the procedure indicated at checkout.
Retention of title: all delivered products remain the property of AeroBand Europe B.V. until the full purchase price has been paid.
You agree to provide current, complete and accurate payment and account information for all purchases, and to update it in a timely manner. You represent and warrant that (i) the payment details you provide are accurate and complete, (ii) you are authorised to use the chosen payment method, and (iii) you pay the amounts due at the prices shown, including any shipping costs and applicable taxes.

ARTICLE 5 - SHIPPING AND DELIVERY
Orders are shipped from our warehouse in Rijswijk, the Netherlands. Unless otherwise agreed, we deliver your order within 30 days of order acceptance. If we are unable to deliver within this period, you will be notified and you have the right to cancel the agreement free of charge; in that case we will refund any amounts already paid without delay.
All stated delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events beyond our control, but this does not limit your statutory rights in the event of late delivery.
The risk of loss or damage to products passes to you at the moment you (or a third party designated by you, other than the carrier) physically take possession of the products. If you have instructed a carrier yourself and we did not offer that carrier, the risk passes upon handover to that carrier.
Pickup in Rijswijk is possible; choose "Pickup" at checkout.

ARTICLE 6 - RIGHT OF WITHDRAWAL (CONSUMERS)
As a consumer, you have the right to withdraw from the agreement without giving any reason within 14 days of the day on which you (or a third party designated by you, other than the carrier) physically took possession of the product. For an order of multiple products with separate deliveries, the period starts on the day on which the last product is received.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the agreement by means of an unambiguous statement (for example in writing by email to info@aeroband.eu). You may use the model withdrawal form (at the bottom of these Terms) for this, but this is not mandatory. To meet the withdrawal deadline, it is sufficient to send your communication before the deadline expires.
After withdrawal, you must return or hand over the products to us without delay, and in any case within 14 days of your communication. The direct cost of returning the products is at your expense, unless stated otherwise. You are only liable for any diminished value of the products resulting from handling beyond what was necessary to establish the nature, characteristics and functioning of the products.
We will refund all payments received from you, including the standard delivery costs, without delay and no later than 14 days after your withdrawal. We may withhold the refund until we have received the products back, or until you have demonstrated that you have returned the products, whichever is earlier. We will refund using the same payment method you used to pay, unless otherwise agreed; no costs are charged for this.
The right of withdrawal does not apply to, among others: products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery; products made to your specifications or clearly personalised; and sealed audio or software recordings whose seal has been broken after delivery.

ARTICLE 7 - RETURNS
In addition to the statutory right of withdrawal (Article 6), you can return or exchange products in accordance with our Return Policy. Returns within the Netherlands are free; returns are accepted up to 30 days after receipt, provided the products are unused, in their original condition and in their original packaging. Start your return via our returns portal. After receipt and inspection, we will refund the amount to your original payment method.

ARTICLE 8 - CONFORMITY AND WARRANTY
We warrant that the products comply with the agreement, with the specifications stated in the offer, with reasonable requirements of soundness and usability, and with the statutory provisions in force on the date the agreement was concluded (conformity).
As a consumer, you are entitled to the statutory warranty: a product must do what you may reasonably expect of it. If a product does not conform to the agreement, you are entitled, at your choice and within the statutory framework, to free repair or replacement, or to an appropriate price reduction or cancellation of the agreement.
In addition to the statutory warranty, we offer a 2-year manufacturer's warranty on AeroBand products. This manufacturer's warranty does not affect your statutory rights. The warranty lapses in the event of damage caused by improper or unintended use, unauthorised repairs or normal wear and tear.

ARTICLE 9 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, marks, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement thereof, are the property of AeroBand Europe B.V., its affiliates or licensors, and are protected by Dutch and international patent, copyright and other intellectual property laws.
These Terms permit you to use the Services solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any material from the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants you a licence or other rights under any patent, trademark, copyright or other intellectual property of AeroBand Europe B.V., Shopify or any third party. All rights not expressly granted herein are reserved by AeroBand Europe B.V..
The names, logos, product and service names, designs and slogans of AeroBand Europe B.V. are trademarks of AeroBand Europe B.V. or its affiliates or licensors. You may not use these without prior written consent. The name, logo, product and service names, designs and slogans of Shopify are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are trademarks of their respective owners.

ARTICLE 10 - OPTIONAL TOOLS
As part of the Services, you may be given access to third-party tools that we do not monitor and over which we have no control or input. We provide access to such tools "as is" and "as available", without warranties of any kind and without endorsement. To the extent permitted by law, we are not liable for your use of optional third-party tools. Any use is at your own risk; make sure you are familiar with and agree to the relevant third party's terms. New features that we offer through the Services in the future are also subject to these Terms of Service.

ARTICLE 11 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to third-party websites (including embedded third-party functionality). We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you decide to leave the Services to visit these, you do so at your own risk. Review the third party's policies and practices carefully before entering into any transaction. Complaints or questions about third-party products and services should be directed to the relevant third party.

ARTICLE 12 - RELATIONSHIP WITH SHOPIFY
AeroBand Europe B.V. runs on Shopify, which enables us to provide the Services to you. However, all sales and purchases you make in our store are concluded directly with AeroBand Europe B.V.. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and AeroBand Europe B.V., including injury, damage or loss resulting from products and services purchased. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising out of or relating to your purchases and transactions with AeroBand Europe B.V..

ARTICLE 13 - PRIVACY POLICY
All personal data we collect through the Services is subject to our Privacy Policy, which can be viewed here, and certain personal data may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal data about your access to and use of the Services in order to provide and improve the Services. Information you provide through the Services is transferred to and shared with Shopify and with third parties who may be located in countries other than where you live, in order to provide services to you. Please refer to our privacy policy for more details.

ARTICLE 14 - FEEDBACK
If you submit ideas, suggestions, feedback, reviews, proposals or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use.
You represent and warrant that: (i) you have all necessary rights to the Feedback; (ii) you have disclosed any compensation or incentives received in connection with your Feedback; and (iii) your Feedback complies with these Terms. We are not obliged to keep your Feedback confidential, to pay for it or to respond to it. We may monitor, edit or remove Feedback that we reasonably consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes the rights of third parties or these Terms. You are responsible for your Feedback and its accuracy.

ARTICLE 15 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on or in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, offers, shipping costs, transit times and availability. We reserve the right to correct errors and to change information or cancel orders if information is inaccurate, even after you have placed your order. In the event of cancellation after payment, we will refund the amount paid without delay. An offer containing an obvious mistake or error does not bind us.

ARTICLE 16 - PROHIBITED USES
You may use the Services only for lawful purposes. You may not use the Services, directly or indirectly: (a) for unlawful or malicious purposes; (b) to violate international, national or local regulations; (c) to infringe intellectual property rights; (d) to harass, abuse, insult, harm, defame or threaten others; (e) to transmit false or misleading information; (f) to transmit material that does not comply with these Terms; (g) to send unsolicited advertising, "spam" or similar requests; (h) to impersonate another person; or (i) to engage in conduct that interferes with others' use of the Services or that may harm AeroBand Europe B.V., Shopify or users.
In addition, you agree not to: (a) upload viruses or malicious code; (b) reproduce, copy, sell, resell or exploit any part of the Services; (c) collect or track the personal data of others; (d) spam, phish, spider, crawl or scrape; or (e) interfere with or circumvent the security features. We reserve the right to suspend or terminate your account if you breach these Terms.

ARTICLE 17 - TERMINATION
We may terminate this agreement or your access to the Services if you breach these Terms, subject to applicable law. You remain liable for all amounts due up to and including the date of termination. The following articles survive termination: Intellectual Property, Feedback, Termination, Liability, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature must survive.

ARTICLE 18 - INFORMATION AND LIABILITY
The general information on or through the Services is intended for general information purposes only; we do not warrant its accuracy, completeness or usefulness. This does not affect the conformity and warranty of products as described in Article 8.
To the extent permitted by law, AeroBand Europe B.V., our directors, employees, affiliates, agents and service providers are not liable for indirect, incidental or consequential damages, including lost profits, revenue or data.
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) our intent or wilful recklessness; (c) our obligations under product liability; or (d) any other liability that cannot be excluded or limited under mandatory law, including consumers' statutory rights.

ARTICLE 19 - INDEMNIFICATION
To the extent permitted by law, you agree to indemnify AeroBand Europe B.V., Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers against losses, damages, liabilities or claims, including reasonable legal fees, owed to a third party as a result of (1) your breach of these Terms of Service, (2) your breach of any law or of the rights of a third party, or (3) your access to and use of the Services. This provision does not apply to the extent the damage results from our intent or wilful recklessness, and does not affect mandatory consumer protection.

ARTICLE 20 - COMPLAINTS AND DISPUTES
If you have a complaint about a product or about our Services, please contact us within a reasonable period after discovery at info@aeroband.eu, with a clear description. We aim to respond substantively to your complaint within 14 days of receipt; if more time is needed, we will let you know within that period.
If we cannot resolve it together, you may submit the dispute to the competent Dutch court. The European ODR platform was discontinued as of 20 July 2025 and is therefore no longer available. An overview of recognised dispute resolution bodies in the EU can be found via the European Commission at consumer-redress.ec.europa.eu/dispute-resolution-bodies.

ARTICLE 21 - SEVERABILITY
If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision will remain enforceable to the fullest extent permitted by law, and the unenforceable part will be deemed severed from these Terms without affecting the validity of the remaining provisions.

ARTICLE 22 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision does not constitute a waiver thereof. These Terms of Service and the policies we post constitute the entire agreement between you and us with respect to the Services and supersede all prior understandings, communications and proposals, whether oral or written.

ARTICLE 23 - ASSIGNMENT
You may not assign this agreement or your rights or obligations without our prior written consent, and any attempt to do so is void. We may assign these Terms and our rights and obligations, provided that this does not diminish your rights under these Terms.

ARTICLE 24 - GOVERNING LAW
These Terms of Service and all agreements under which we provide you with Services are governed by Dutch law. Disputes will be submitted to the competent court in the district where AeroBand Europe B.V. is established. This does not affect the mandatory consumer protection applicable in the country where the consumer resides, nor the consumer's right to bring proceedings before the court of their place of residence.

ARTICLE 25 - CHANGES TO THE TERMS OF SERVICE
You can view the most recent version of the Terms of Service on this page at any time. We reserve the right to update these Terms by posting changes on our website. We will inform you of material changes in accordance with applicable law. Orders already placed remain subject to the terms that applied at the time of the order.
